The 100% Experience Modifier Cap is a program offered by the Ohio Bureau of Workers' Compensation (BWC) that limits the increase for an individual employer's experience modifier (EM) to minimize the effects of a significant premium increase for employers that become penalty rated. In essence, this program limits an employer's EM percent increase to no more than double the previous year's EM percentage.
Eligibility Requirements

To participate in the 100% EM Cap Program, employers must meet the following eligibility requirements.

  • Employer must have an individual EM for the current policy year of 1.01 or greater.
  • No more than 40 days of lapsed coverage within 12 months prior to June 1 preceding the rating year.
  • No more than 45 days past due on any premiums, including retrospective rating billings.
  • Cap does not apply to employers whose EM is calculated with more than one policy's experience.
Eligibility Requirements

In exchange for the discount offered by the EM cap, BWC requires participants to make improvements to their safety programs. CareWorks Consultants, Inc. provides services to assist employers with successful participation in the 100% EM Cap Program. CareWorks Consultants' team of seasoned rate and safety professionals will guide you through the following requirements.

Year 1:

Employer must attend an industry-specific, half-day training program.

Subsequent Years:

Employer must attend an on-line training class.

Eligibility Requirements

Private employers must submit to BWC, by September 30, a completed Agreement for 100-Percent EM Cap (Form U-18). For public employers the U-18 form must be submitted to BWC by March 31.

Employers participating in the 100% EM Cap Program cannot participate in group experience rating, individual retrospective rating, drug-free safety program or self insurance.
